A claim to the Criminal Injury Compensation Authority (CICA) can be put forward if you have suffered mental or physical injuries because of a violent crime. All eligible claims will be paid by CICA, who are a government agency. Most cases can take up to 12 months to complete with the more complex applications taking even longer to reach a conclusion. Factors which can lengthen the time to receive your compensation are as follows:
- If any medical treatment you receive as a result of the injuries you suffered is still ongoing
- If your level of recovery, or recovery time, is unknown
If a settlement has to be delayed CICA may offer an interim payment.
How much CICA compensation will I receive?
The amount of compensation you will receive is determined by the authority’s tariff of injuries. This details the severity and number of injuries you suffered. CICA will pay compensation for up to three injuries totalling a figure of between £1,000 and £500,000. If you have more than one injury that each would qualify for a claim, you will receive the following:
- 100% of the full value of the most serious injury
- 30% of the full value of the second most valuable injury and then 15% for a third injury
Here at St Helens Law, we work on a Contingency Fee basis. If your claim is unsuccessful you will be charged no fee. If it is accepted and you receive compensation, we will charge at a rate of 25% of the figure you receive.
Am I eligible to claim?
So long as the crime you were a victim of took place in England, Scotland or Wales and it was reported to the police you will be able to claim. Your application must also be submitted within two years of the crime being reported to the police.
